“The
Goldwater Institute, a conservative watchdog group, had filed the lawsuit in
January 2017 against the district, school board and the JCEA on behalf of two
Jersey City taxpayers. The lawsuit argued that the district agreement that
permitted the teachers to stay on the public payroll while working exclusively
on union business violates the state constitution’s ban on public gifts.

Jon Riches called it a great day for New Jersey taxpayers. He previously called
the practice an “egregious form of government cronyism.”
The ruling "is a win for taxpayers in the Jersey
City school district — they should not have to foot the bill for the activities
of a private union,” said Riches. “The court was right to hold that “release
time” is unlawful, and we will continue to work to defend the rights of these
taxpayers.””
