The Lodi council passed a Resolution waiving their
health benefits from January 1, 2010 to December 31, 2010 in order to “grant the taxpayers of this
community with some measure of financial relief.”
The State enacted a new law on May 21, 2010 prohibiting
part-time elected officials from receiving health benefits through SHBP if they
were not enrolled or eligible on that day and continuously thereafter.
Marc was not
enrolled on that day. Nor was he
eligible on that day. His benefits were
waived (by Resolution) through December 31, 2010. The Resolution was written by a Borough Attorney. It is a legal document.

The Resolution made Marc NOT ENTITLED at the time he began charging the Lodi taxpayers.

There was no Resolution un-waiving them. Yet, Marc
decided to take them anyway.
Marc needs to right his wrong. He needs to pay back the taxpayers of Lodi
for the cost of his health benefits.
Joyce Decker should have taken the initiative to
review Lodi’s Resolutions before she invented a new way of transferring Marc’s
bill from the Meadowlands Commission over to the Lodi taxpayers.

Mr. Spiniello gets paid by Lodi to represent Lodi. He should sue Marc Schrieks on behalf of the Lodi taxpayers to recoup their money.
