4A:8-2.2 Exercise of
lateral and demotional rights
(a) Employees shall be
ranked, for purposes of exercise of layoff rights, in order of seniority.
If Civil Service signed off on Luna's layoffs, they
likely did so because Luna misrepresented the facts to them.

EMPLOYEE LAYOFF RIGHTS.
The 2 employees targeted for layoffs do not have the
least seniority. In fact, they have more
seniority than the Deputy Mayor’s son.
Both employees have bumping rights (lateral or
demotional) over the Deputy Mayor’s son.
Nobody can argue that the job responsibilities for
the DPW and “Building and Grounds” are not similar. The Deputy Mayor’s son does not hold any
special skills, licenses, certification, education, or experience requirements
that would preclude either of the two DPW employees from filling his job.
Luna has publicly stated that the Deputy Mayor’s son
did not receive a promotion and is on the same steps as the rest of the
DPW. Therefore, it all comes down to
seniority.
If the Deputy Mayor wants a layoff to save money,
she should start with her son. “Do as I say, not as I do.”
